The last two years has witnessed a rapid rise in the use of AI in healthcare, from AI-powered pathology and radiology tests to the use of AI scribes in the clinical consultation. It is now estimated that up to a quarter of Australian GPs are using or preparing to use an AI scribe in their daily clinical practice. While the potential benefits are undeniable, there are legal, regulatory, ethical, and professional issues that also need to be understood, including consent and privacy. As new uses and functionalities are added to AI scribes, this also raises questions over their unregulated use and the weight courts will attach to AI-generated records in the context of civil litigation.
